The basics
These terms are an agreement between you and New House Ventures, LLC ("Cutler", "we", "us"). They cover cutler.munatti.com, the Cutler web app, and songs you send us for splitting. By paying for, uploading to or using Cutler, you agree to them. If you don't agree, don't use Cutler.
You must be at least 13 to use Cutler. If you're under 18, a parent or guardian needs to agree to these terms for you.
What Cutler does
Cutler splits a song into separate stems and builds files from them: MIDI, Apple Loops, sample kits and playable instruments, depending on what you buy. Splitting is done by software, and results depend on the recording. Some parts of a song may bleed into other stems or come out quieter or thinner than in the original. We don't promise that every stem will be perfectly clean.
Your music
Only send music you have the right to use: your own tracks, or songs you're licensed to sample or remix. You're responsible for clearing anything you release or share that's built from Cutler files.
You keep ownership of what you send. You give us permission to store, copy and process it only to make and deliver your files. That permission ends when the files are deleted. We don't claim ownership of your songs or of the files we make from them.
Buying from Cutler
- Single songs and packs are paid once, through Stripe. Each purchase covers the number of songs listed. Founding packs are limited to the first 50 buyers of each pack.
- Monthly plans (Deck and Studio) renew automatically each month until you cancel. You can cancel at any time from your billing page, and your plan stays active until the end of the month you've paid for. Songs you don't use in a month don't roll over.
- Extra songs bought as a top-up don't expire while your plan is active.
- Song limits: each plan and pack has a maximum song length, shown when you buy.
- Prices are in US dollars. We may change prices, but a change never affects something you've already paid for. Monthly plans get at least 14 days' notice by email before a new price applies.
Delivery and refunds
For single songs and packs, send your song through the upload link after paying, using the same email you paid with. Finished files are delivered by email with a download link, and each download stays available for 14 days.
If something is wrong with your files, such as a missing stem, a broken file or the wrong song, reply to your delivery email. We'll fix it, or refund that song if we can't. Because each split uses real processing time, we don't otherwise refund songs that have been delivered. Unused songs from a single or pack purchase can be refunded within 14 days of purchase.
Using Cutler fairly
Don't use Cutler to infringe anyone's rights, upload anything illegal, interfere with the service, get around plan limits, resell access, or scrape or copy the service. Accounts are for one person. We may suspend or close an account that breaks these rules.
Copyright complaints
If you believe someone used Cutler to process your work without permission, email hello@munatti.com. Include the work, where it appears, your contact details, and a statement that you believe in good faith the use isn't authorized. We'll act on valid complaints, and we close the accounts of people who repeatedly infringe.
Our part
We work hard to keep Cutler running and to deliver good files, but the service is provided "as is", without warranties of any kind, to the extent the law allows. That includes warranties that it will always be available, error-free or fit for a particular purpose.
To the extent the law allows, we're not liable for indirect or consequential losses, such as lost profits, lost data or lost opportunities. Our total liability for any claim about Cutler is limited to what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.
If someone brings a claim against us because of music you uploaded or how you used Cutler files, you agree to cover our reasonable costs of dealing with it.
Ending things
You can stop using Cutler and cancel your plan at any time. We can suspend or end your access if you break these terms, or if we shut the service down. If we shut down, we'll give you notice and refund any unused, paid-for songs.
Law and disputes
These terms are governed by the laws of the State of Wyoming, USA. Any dispute will be handled by the state or federal courts in Wyoming, unless the law where you live gives you the right to bring it in your local courts. Before going to court, email us and we'll try to sort it out directly.
Changes
If we change these terms, we'll update the date at the top. For bigger changes we'll email account holders before they take effect. If you keep using Cutler after that, the new terms apply.
